The H-1B visa program is not disappearing in 2026, but it is changing in meaningful ways that directly affect hiring strategy, budgets, and candidate conversations. Recent headlines have created confusion, so it’s important to separate what is already in effect, what is officially changing, and what remains proposed but not law.

First, a $100,000 filing fee is now required for new H-1B petitions for workers applying from outside the U.S. This fee, effective since September 21, 2025, does not apply to extensions or changes of status for individuals already in the country. The cost alone is reshaping how employers plan international hiring.

Second, beginning with the March 2026 registration period, USCIS will move from a purely random lottery to a wage-weighted selection model. Higher-paid, highly skilled roles will have better odds of selection, while lower-wage roles remain eligible but face steeper competition. The lottery still exists, but strategy now matters.

Finally, while a bill has been introduced in Congress proposing elimination of the H-1B program, it has not passed and does not currently change the law. The program remains active.

The takeaway for HR: H-1B is still here, but planning, compensation strategy, and communication matter more than ever.
